BMW Class Action  Lawsuit by Margarian Law

The Law Offices of Hovanes Margarian has filed a major class action lawsuit against BMW of North America, LLC, the manufacturer of BMW and MINI vehicles. The plaintiffs accuse BMW of manufacturing and retailing over one million (1,000,000) vehicles with a defective Auto-Start-Stop system.

What is Auto Start-Stop system

Auto Start-Stop system makes the engine turn off when the driver stops the car. Afterwards, the car is unable to re-start when accelerating. It can put drivers and passengers in a life-threatening situation. Moreover, the faulty Auto Start-Stop system results in premature engine wear. It causes also the failure of its components. The condition is so heavy in some cars that BMW of North America is due to permanently disable the Auto Start Stop function. Moreover, it charged some owners for the costs of labour in doing so.

The plaintiffs allege that the manufacturer was aware of the malfunction for years and was unable to provide an appropriate remedy to the BMW owners. In addition, the automaker continued to make and retail these cars failing to reveal the material defect to the customers.

BMW class action lawsuit was filed in Los Angeles Superior Court, Central District. The estimated amount of the BMW class action lawsuit is more than one billion dollars ($1,000,000,000). The company have sold BMW and MINI cars not only in California but in the entire United States. Accordingly, they will most likely remove the lawsuit to Federal Court.
